Stormwater Management Ordinance

The Libertyville Municipal Code (LMC) Section 20.5 comprises the Village’s Stormwater Management Ordinance and includes three Articles.

Amendment to the Lake County Watershed Development Ordinance (WDO) 

In 2015, the Village of Libertyville adopted a local amendment to the Lake County Watershed Development Ordinance (WDO):  Appendix P – Stormwater Management Regulations.  These regulations were further revised in August of 2019, and establish requirements and guidance for the provision of stormwater management for smaller developments that would otherwise fall beneath the detention requirement thresholds of the WDO.  Information on the Appendix P regulations can be found here.

Lake County WDO (Sections 300.07 to 300.09) 

300.07 
Any public road development meeting both of the following criteria: 
A. One and one-half (1.5) acres or more of new impervious surface; and 
B. One and one-half (1.5) acres or more of new impervious surface per mile, for linear or nonlinear projects; or 

300.08 
Any development that hydrologically disturbs 5,000 square feet or more. This development activity shall at a minimum meet the soil erosion and sediment control performance standards of §600 Performance Standards, with associated application requirements. Public road developments are required to meet the soil erosion and sediment control standards only for those projects which require permits according to 300.01, 300.02, 300.03, 300.04, 300.05, and 300.07; or

300.09 
Any activity to a building in a Special Flood Hazard Area (SFHA) as described in 
FEMA Publication 480 National Flood Insurance Program Flood Management 
Requirements. 

Village Revisions to WDO (Sections 300.07 to 300.10) 

300.07 
Stormwater Management Regulations for New Impervious Surface Area: 
In accordance with the Village of Libertyville's Appendix P Stormwater Management Regulations, storage volume shall be provided to offset the increase in stormwater runoff that may result from any site improvements within designated areas that result in a net increase in impervious surface area of 400 or more square feet.

 
300.08
